Oh no, I’m totally aware of all that stuff. The whole implicit right interpreted in via precedent and all that. But you are aware that law enforcement doesn’t follow any of that stuff…right? A cop thinks that probably cause is anything he wants it to be, hell, a lot of them will just tell you that.
How about this, go and speak with an attorney in your city and ask them, “at what point does my right to privacy prevent the police from searching me and seizing my possessions?” Come back and tell me what they say. Are you familiar with civil forfeiture? Do you realize that in studies that have been done something like 80 percent of drugs dogs give false positives? You know that they just train the animals to alert on demand, and they use hearsay and snitches to get their real info, which isn’t supposed to be the kind of info that you can use to get a warrant…right? They use the dog as a way to effectively negate your right to privacy.
Police don’t arrest for privacy violations, but people can sue via civil courts.
Yes, the police use a dog to legitimize hearsay, then once they arrest someone that person can sue them for violating privacy as long as they didn’t rob him blind under civil forfeiture. Yea that’s how it really goes in the real world those cases are totally winable.
I think a cop shining a light in my back seat for longer than it takes to see if a person there is a search. If you got the light in there for 30 seconds moving it slowly around, then what the hell are you doing? I mean, it shouldn’t fall under the plain sight doctrine if you need a light to find it. And it can’t be a protective search if you can quickly ascertain that there isn’t anyone back there. But it’s standard procedure when someone gets pulled over at night and profiled that they bring in a few cops and stand around trying to intimidate him for a bit while looking all around with their flashlights.
I’m saying they’re the ones committing them. It’s the only way they can do what they think their job is apparently. So the way it’s actually working is that if you’ve got a right to privacy in some narrow sense then it doesn’t apply if the police are the ones violating it.
