I need to know the particular statute(s) in the UCMJ (uniform code of military justice) covering the issue of … well… okay…
Say “Halo” is raped and nearly strangled to death by “Wayward Son” and they catch him in the act? What is the protocol for what happens next? If “Wayward Son” is free to come and go as long as he signs in and out – are there grounds for… complaint, or whatever? If it is legal for him to not be behind bars right now (if I were the prosecuting attorney, I would request him held w/o bail, but the military doesn’t have “bail”) – which particular statute(s) do I recommend be changed? Any recommendations on how they would be restated/reworded? Do I “really” have to contact Donald Rumsfeld in order to start the process of changing the statute(s)?

I am not sure which “statute” you want changed… even if there is overwhelming evidence he did the deed, he is entitled to “due process” and that could mean mere confinement to the base or post until trial or court martial…
Thankyou so much, Imp. I am not being informed of the charges. He had not been charged, they were still investigating it, the last time I contacted the JAG officer prosecuting the case (it is his claim that he is the prosecutor, not mine, in case that sounds fishy… but he did say that he may not remain the prosecutor, depending on some factors) (to me it sounds fishy because he was initially referred to as the soldier’s attorney). I was given some information by a third party but have not gotten through all of it. I really appreciate your willingness to help. I’ll keep you as posted as I can keep you.

Well, for some strange reason, those fact sheet links aren’t working anymore.
Did my own search and here’s what I’ve got so far (btw, they are still investigating Wayward Son, and I sent the JAG officer a print out of policy encouraging him to take more care in confining him and protecting Halo, and made him aware of a possible, publically available prior conviction… so that’s my update for now… I’m going to wait and see how this pans out before I look further into changing something that may not even be “broke”)…
Adlerian, I am a concerned citizen, if that answers your “what are you?” question. You don’t think this thread should have been posted, because it lacks context? A girl got raped and strangled and the guy is not, in my opinion, being properly restrained before his trial. I am researching the “why” behind it, to find out what it is exactly that needs to be changed, rather than just whining about it and doing nothing to fix it. Is that not enough context?
By the way, when I first joined ILP it was under the name Sheâ„¢ – I changed it to “somenewname” – then “Nell” briefly – and it is back to Sheâ„¢. You might remember you and I had a discussion about what went wrong with Joseph Duncan. Not sure if that’s what you meant by “what” are you – but, maybe that will help answer the question.
Any opinions would be appreciated. I just heard on the news that a guy got probation for raping a boy – no jail time. How did this guy get started down the road to being a pedophile rapist? How can we stop this disease from taking root in the first place? The statistics on Internet child-porn – how many people will pay for it – very, very disturbing. It’s sad to consider how many people check out the free stuff. It’s sad to think about the kids who are being exploited instead of being kids. What kind of people will they go on to become?
