Im really annoyed, I got accused of hitting a car in a parking lot. I DIDNT HIT ANYBODY!! How much sense does it make that I would hit a car in a parking lot, park it there, and then go to work for the day? Anyway, apparently there are “witnesses” (pfffffffftttt). The cops were called and they got my licence plate down. I havent been contacted yet at all and they couldnt find me the day it happened (a week ago). I just found out about all this today, anyway, my question is, what do I have to look forward to? What happens now?
First of all you should state that you did not hit any car, and that the whitnesses must be mistaken.
Look for evidence, there could be paint on the other persons car or if you hit a car, your car should have marks on it
When the cops say that they have 2 or more credible whitnesses claiming otherwise, tell them that you guess it’s your word against theirs…
And if you’re feeling cheeky, say “frankly it seems to me that this is all hearsay for the fact that i did not hit any cars”
The burden of guilt lies with the prosecution. Since you allegedly hit the other person’s car, challenge them to inspect your car and see if there is any physical evidence on your car.
If there is not, but they contest that you had it fixed/painted, then you can challenge them to run a chemical analysis on the paint on your car to determine its age, nobody is going to pay to do that!
If they’re charging you with a criminal offense, then don’t write a statement or answer any question. 90% of the evidence that gets used against people in court is evidence that the people just give to the police in the form of statements or by answering questions. Do not let your insurance company pay anything, or your rates will go up. You can get an accident report thrown out in court if you try really hard. How much damage is there to the vehicle that you supposedly hit?
Smears is talking some good sense.
I’d recommend getting a lawyer, actually. Hit-and-runs are no joke.
I did this once when i was a stupid hippy. Got caught and had to pay. My car was bright orange.
