It is illegal to have sex without consent, including when an individual is unable to give consent due to unconsciousness or intoxication. However I propose a moral dilemma for your consideration:
A drunk woman tells a sober man she wants to have sex with him. She is obviously drunk (slurred speech, staggering etc.) but still conscious. The man has sex with her. Is this man guilty of rape? Is the woman responsible for her actions?
Would the woman be guilty of rape if she were sober and the man drunk?
If the woman drinks and drives she is held responsible for her actions, therefore is she not responsible for her actions when consenting to sex?
I would never fuck a drunk women, it’s a massive turn off. I want her sober and knowledgeable about what’s happening, and willing. It helps my mother was a drunk slut in taking the antithesis.
I have considered these questions in the past, especially given the supposed equal treatment of the genders, and have found that the following answers are my conclusions:
Is the man guilty of rape?
I would say absolutely not. We are assuming, of course, that this is a man with whom she would not have sex were she sober, of course. If the drunk woman is walking across some sort of bridge, decides to sit on the railing, falls off and drowns, do we fault the river for being there? The bridge being there for her to sit on? It’s nonsense. Certainly, there are varying degrees of intoxication, so there remains, in my view, a moral question that the man must ask himself with respect to whether or not he wants to have sex with a woman whilst she is in such a state, but no further.
Furthermore, it is my understanding that men can be held legally accountable if both parties are drunk, which is complete nonsense.
Is the woman responsible for her actions?
I am of the opinion that every individual is always responsible for his/her actions (with few exceptions) because decisions made when an individual was, “Out of control,” often stem from decisions made when the individual was in control and made decisions such that the result was the individual becoming out of control.

To the extent that the man is considered guilty, the answer is yes. The thing is that you aren’t generally going to have a male make any sort of claim with respect to such a matter because he is often not ashamed of his actions in having sex with a woman…at least, not ashamed enough to ruin someone’s life over it. Further, he has to be able to, “Rise to the occasion,” as it were, so his doesn’t really have much in the way of deniability with respect to whether or not he wanted to have sex at the time…

Men are wierd. Drunk, she is responsible, passed out drunk woman , back off quickly and leave her in a safe secure place or its your ass if something happens to her.
This topic is, to me, an example of how ‘having sex’ has become more important than ‘sharing sex.’ You may label me what you will, but ‘having sex’ is, to me, nothing more than an individual act of physical gratification–for either a man or a woman. The difference is that a woman can’t have sex with a drunken man, because he can’t really ‘get it up’ in most cases.
Yet men can ‘have sex’ with anything that’s round and rubs against his penis–which can be anything from a vacuum hose to a knothole in a board. What man would want to have sex with an essentially comatose partner?

I don’t think that a man can have sex with a drunk girl. If he can insert his dick into her without waking her up, then he has a small penis to begin with.
