It just occurred to me… I was a supporter of The Line Item Veto back when Clinton first started doing it, made sense, had to go back and be reapproved. It was ruled unconstitutional.
The Strike and Replace scam Obamacare was done through more or less precisely parallels this. The Senate took a bill that originated in the house, completely gutteted it, turned it into something very new. For some odd reason we still haven’t had a case dealing with this directly. We can close last year, but the question wasn’t specifically brought up.
If the president isn’t able to modify a bill from either the House or Senate, essentially gutting it, making it into what he wants it to be, how can the Senate completely gut a House of Representatives Bill, and trespass on the Origination Clause? The Senate is no more empowered to tax for raising revenue in a bill, by morphing a former House Bill that doesn’t specifically enumerate funding, than the president have power to legislate by a even more minor, surgical gutting…
Senate can send a bill back to the house to approve, if they really wanna change stuff up… but lack the ability to tax revenue on their own part. Completely powerless. Just like the president is powerless to modify bills as he sees fit.
On the supreme court level of president, I don’t know how it can uphold Obamacare without giving the green light to presidents to start shifting funding war campaigns via this method without representative consent. If the House doesn’t want to cooperate, go to the Senate!
At what point does the Constitution get to prevail over a Democratic Party veto against mechanisms that are vital to other portions of government. We only got one Origination Clause, the founding fathers didn’t leave two… one for Americans till and after Obama, and a second clause to be used as a loophole made prophetically in advance just for Obama in this one case, to do as he damn well pleases, but we will hold very strictly to it in all other cases.
I was under the distinct impression, from supreme court president, the only thing able to strike out a law was it being in violation of the constitution, not natural law, common law precedent, not a exexutive’s legacy, not wish fulfillment. Only thing able to strike out a constitutional clause is a amendment.
We had a hierarchy to it all till this, and all of the sudden the rules guiding our laws switched from hundreds of years of strict observance and examination of constitutional powers, to Teletubby Physics, reordering the laws of our legal universe to appease some sunbaby in the sun, giggling over the chaos it has wrought.
Presidents can’t even strike out single lines, that’s how important bills are considered. How the he’ll do we drop the origination clause, when our whole point of being a nation came from No Taxation Without Representation? Its a obvious as fuck rule, one that has been perpetually enforced, it’s not some hippy pothead issue, where you can light up a bong and bounce around in a room with other stoners, flailing your arms and mouthing your mouth in O’s, like a Goldfish, telling one another the Constitution is a living document, capable of being whatever you want it to be with the right thesaurus. It fucking ain’t… this hits at the very crux of America, the literal cause and reason for our existence.
If we can’t maintain this rule, we might as well call Bullshit on the whole wWar of independence and Sovereignty claims, go apologize to Parliament and ask for readmittance into the Empire, reimburse them for the Boston Tea Party… retract the Declaration of Independence as Drunk Texting (OMG Sorry 
) and let them forceably garrison troops in our home. We can have the Queen on our currency, and Sir Elton John will have the right to ride any American around as a horse, because British Knights can do that sort of thing legally to peasants who lack rights.
Which is pretty much the crossroads where we are at this point. We have centuries of precedent, and suddenly “ohhhh no no no no no it can’t apply to this one case, our politics party doesn’t want to have this issue right now, just bend over and take it America, we know best for you!”
