Look what I just found, purely by accident, I was looking up 5th Amendment militia detainment standards, then found this little beauty regarding citizenship.
First, the US Version, then the Confederate Version.
Now, the Confederate Constitution:
Ha Ha Ha Ha
Now what is the legal standings of the Confederate constitution today? Nilch. However, it does lend very strong historical collaboration that earlier eras (at least since the civil war) interpreted the language in the constitution so as to implicitly prohibit Cruz from being a head of state.
So not only would Cruz be unable to be president of the US, but also of the Confederacy, which used a nearly identical worded phrase, and US court president, to come to it’s legal conclusions. This doesn’t reach back to the era of the 1789 Constitution however, as it is a civil war document. But it is like, 70+ years after the fact. Did the meaning really change that much?
So Obama has to deal with the birthers who take any and all including the most absurd angles to try and get him out of office on these grounds, but when a republican wants to be president…well…there he is just running a campaign like it’s no big deal that he’s from someplace else.
The Obama birther issue was backlash against Democrats attacking John McCain for being born in Panama. If McCain would have won, it would have been the anti-McCain birthers we’d be hearing about now, not the Obama ones. Though of course, the news and you wouldn’t call them ‘birthers’, you’d call them “Concerned Legal Scholars” and their concerns would be 'serious allegations" as opposed to a ‘whackjob conspiracy theory’.
I was far more sympathetic to Obama than Cruz, Cruz admitted to being a Canadian, Obama never did. I can’t disprove Obama lied, but I am increasingly finding evidence Cruz isn’t eligible.
I don’t care if it’s a guy from the Nation of Islam, or even a Commie Bastard like Sanders (who is Bona Fide American), just so long as he/she is American born. We gotta have some local, home grown contenders for presidency. Why is it always in the last few elections it’s like McCain in the Panama Canal, or Obama who was maybe born in Kenya, or Cruz who is about as eligible for the Presidency as Gib is?
I’m only 32, few days from 33. I can’t declare myself as running for president for the sole sake of suing this guy, I gotta be 35. Somebody old enough (better make sure your American first) needs to declare they are running for president, and sue Cruz.
I’m sick and tired of the constitution being trampled on. We have already seen the constitution severely trampled on this past year by the judicial branch, I don’t need to see it collapsed by the executive this year.
Honestly, I would sooner have Sanders as President knowing there be a strong Republican majority in both houses, than a Canadian President assuring me he is going to build a wall to keep illegals out. I know Sanders will have to be very Frank and accommodating to get anything done, no reason for him to act otherwise… who knows what a Canadian in the White House will do? They tried to kill George Washington. Don’t let that fucker in, last time a Canadian got close to the White House, they burnt it down.
Americans First dammit. Maybe if we run out of legally qualified Americans, we might get a Mexican to run… most they did was shoot up the Alamo, but never a Canadian. Cruz is little more than a puppet of Trudeau.
You know what really gets me about Ted Cruz? Its his disloyalty. He renounced his country, turned his back on them, out of political inconvienance. I would rather a Winston Churchill be president, his mother also was American:
He was able to stand with his country in its time of need, yet still be proud of his American ancestry, used it to forge a Anglo-American pact.
He was always proud to say he was a American Citizen, and Subject if the British Crown.
You know what… it just occurred to me, being a subject of the monarch, though it coincides with being born in Canada, renouncing your Canadian citizenship might not eradicate his being a subject of the crown, as the crown is more that Canadian citizenship, lots of Non-Canadians are subjects of the crown.
Just found the smoking bullet, now 100% positive he can’t be president.
Notice that the principle for accepting citizens is merely a congressional act, AFTER the 1989 constitution was passed. The qualification for president doesn’t encompass this scope, and constitutional law isn’t amendable by Acts of Congress (save maybe a treaty of surrender).
So the US constitution doesn’t recognize Jus Sanguinis as a qualification if being a natural born citizen, but our legislative body, which doesn’t have the legal authority to override the constitution, has since (in my opinion lawfully) added additional avenues for citizenship through ancestry.
For example, people born in former US territories long since given by treaty to the British Empire, inherited by Canada, had mostly US Citizens at the beginning of the exchange. Under the 1790 civil law ruling, their children would be American (if they so bothered to claim). We didn’t have strict immigration laws then, be a good century before anyone noticed, but in theory, half of Canada could have claim at this point to being American Citizens. I believe we at some point (heard a long while ago) we limited this to two generations of US citizens can pull this off. So literally, Gib (forum Gib) might have a better standing for US citizenship than Ted Cruz, but I’m 99% certain Gib isn’t eligible, as the US wouldn’t allow most Canadians to be American. We would straight up annex the place if that was the case.
So from this point on, I’m 100% certain Cruz doesn’t qualify as a natural born citizen. Its a constitutional clause, nor a federal civil clause, and his arguments lack the criteria to qualify him.
He is making false claims to a type of citizenship he doesn’t qualify for, I don’t want it coming down to a Supreme Court Justice refusing to swear him in because he isn’t qualified, on the date of assuming presidency, having to turn the presidency over to Hillary, The Butcher of Libya the runner up.
Good point. Wait…not really. I mean…did you just do the whole, “the other guy did it first, and my crystal ball tells me that had it went the other way then they would be even worse”? Are you serious?
You notice Smears I dislike them all equally for trying to run illegally, and gives a fuck about the racist angle. I just want the constitution followed. I’m not going to bend the rules this time around cause a couple racists went after Obama over his origins, most modern day racists are dumbed down Nietzscheans, so fyck em. If your not a American, period, your not allowed to be president. Even if your a commie or a fascist, or a liberal, or a conservative, etc… you can run, as long as your American. If I could figure out a way to do away with political parties I would. I’m not backing down cause some scumbags in the KKK exploited this clause, it exists with or without them, and I have no double standard on this. Ted Cruz has to go.
Hmm, let me type it slower so you’ll understand it. You’re weeping about an imagined scenario in which Obama’s birthplace issue are taken more seriously than Cruz’s, in a thread the purpose of which is make a big deal out of Cruz’ birthplace issues, which was provoked by the fact that the exact same person who is infamous for criticizing Obama on these grounds is doing the same thing to Cruz.
So technically, your point is so retarded that giving it any reply at all is a charity.
What I’m doing is reminding you that it was actually Democrats that were preoccupied with this shit in the first place, and the only reason we’re talking about Obama’s birthplace issues is because he won, and McCain’s issues no longer matter.
So that’s two points to consider- the idea that Dems are being treated worse than the GOP on birther issues is a fantasy, and the idea that the GOP have any special association with the ‘birther’ complaints such that they can be held accountable for this imaginary unequal treatment is also a fantasy. The speculation that if a Republican’s citizenship was being question the media would take it more seriously isn’t peering into a crystal ball so much as reminding you that it was and they did:
Ucc, no one’s weeping here. You’re just doing what you always do. You’re just so far right that you think everyone is far left, and you’re doing your same tired routine because the Obama birthplace thing is apparently a sensitive issue for you. Take it up with someone else. I’m not interested. Say it slow for me? Riiiight. Keep kidding yourself.
I want his ass removed, I’m not a Republican, I’m even pro Sanders in a degree. I’m probably the best read person here in eastern philosophy, and I’m still the most adamant on tossing his ass out. Uccisore is allowed to uphold the constitution, upholding the constitution doesn’t make you a racist, being a racist like Smears, suggesting people are racist when they are not racist on account of their race is. If Uccisore was Black, Asian, Native American, or Hispanic, would he be a racist? No.
So drop the shit you drug addict. Cruz isn’t American, and is a massive hipocrit for being a originist on the constitution, while violating one of it’s essential safeguards to keep the republic from crumbling. We put that clause in for a damn reason. Thus constitution has kept us going for centuries, you can legally amend it. Arnold Swartzennegar can’t be president either, and he is probably the most popular white guy in America. If we didn’t bend the law for him, why should we bend the rules for someone who should know better? Cruz can run for governor in many states, be a Senator or Representative, just not President. It is off limits. Your skin color doesn’t matter, your ties to the soil does. He was born elsewhere. Its not a race issue, but a constitutional one. Koko the Gorilla has a equally good claim as Cruz… she IS born of the soil, unlike Cruz, but ISN’T a citizen. If Congress granted her citizenship, she would qualify. Congress can’t grant Cruz honorary birth within US borders, it’s a fact he was born elsewhere.
Therefore, Ted Cruz is as screwed as Koko in becoming President, but at least she has a potential shot for it if Congress extends her humanhood. All the little constitutional checks thereby are complete, and she could run. Cruz can be her campaign manager.
“No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.”
So you have to be a natural born Citizen and have been a resident within the United States for fourteen years.
What could natural born citizen mean?
I know it! In the 18th century they meant that you are born the natural way and not via caesarean section…
No… probably not.
Now I know it… It means that if your mother gave birth to you on foreign soil, it means you should not be eligible to become the President of the United States because the magic dirt was absent. That’s what they must have meant by natural born citizen.
They must have been thinking - “How do we keep America to be about Americans?, I know! - We make sure that future American presidents are born on the magic dirt found within the borders of the country. As we all know, the borders are about separating the dirt of America from the dirt of other nations.”
That’s how it all happened back then. The word nation from the latin word golem - to be made from dirt.
Let’s cut to the chase, America should remove ‘natural born citizen’ from its constitution because it doesn’t mean anything anymore. It’s a farce to speak of ‘natural born’ in modern, diversified, anti-racist America.
That has been the purpose of each and every unconstitutional act for the past 40 years … removing the constitution. Socialists cannot tolerate constitutions that limit their power over their sheeple.
I despise cruz and he is an American, just as American as I am
and I was born in Minnesota with American parents. The man is unfit
for the presidency because he is a self serving worm who couldn’t
outthink a paper bag.
