Who is the soverignty in Democracy?

IF it is the people, then is not democracy a form of communism?

Is the sovereignty, the three branches? Would not soverignty be a rule, an idea, a principle, that is made up by the people?
Mostly, would be buisnessmen, protection, priveieges, more benefits?
would not this be a form of oligarchy?

I am starting to understand why democracy is right, and went against Aristotle.

If by a sovereign you mean “who holds all the power”? The answer is – no one. The power is shared. In fact, in the political theory I’ve read, there is no sovereign but God. So in a mixed government, each branch has a chance for reason to hit them and check any other branch: – which is an advantage over humans claiming sovereignty.

I think that legal laws, in a free state, should be based on the natural law.

And Impenitent has a point in his first two responses. Are we speaking of a straight democracy in this question, or of a democratic republic?

Why would you be concerned with the constitution when the gunholder is sovereign? Didn’t you call it “a scrap of paper,” Impenitent? Or were you joking/being cynical there?

there is no sovereign ruler in a democracy.
soverignity, or whatever the term is, refers to an absolute authority, as IMP implide, a democracy is controlled by the people, which is shared equally.
as to your original question about it being like a communist gov’t though, it is different in who owns the property and goods. in a democracy, the people own their own property and goods. in a communist country the gov’t controls it all and apportions it out. no one can gain or lose in regards to their neighbor.
