Michael Morales was scheduled to die Tuesday
by lethal injection. A federal judge demanded that
licensed medical personnel to take part in the execution.
California, like most states, carries out lethal injection with
three drugs- one to relax, another to paralyze then and the
third to stop the heart. The problem has been sometimes
the prisoners feel excruciating pain if still conscious when the
paralyzing agent is administered. That would make it
cruel and unusual punishment. Now for this execution,
the judge demanded a licensed anesthesiologist, to
oversee and administer the injections. The legal problems
also extend to the fact that there are limits to practicing medicine with
controlled substances, it appears prison personnel in the prisons
are breaking the law because they lack the licensed to do this which
was a factor in the judges decision. Now the state of California
could not find a licenced doctor an/or anesthesiologist to administers
the drug. Which also creates a problem for the doctor,
who because it causes a death, could face losing their licences
with these cases. So legally, no one can really administrate
these drugs. This basically means any state which uses
lethal injections as a means of execution, must wait for the
supreme court to decide if it is legal despite the legal issues.
